The remarks of the chairman left an ambiguity that defendant is guilty but it can`t be proved to the required standard. You seem to wish for such plain honesty from the bench, but castigate it when it is seen.<br /><br />What I am sure of is that not proven verdicts are not "respected" by anyone involved in the process in Scotland. Rather they engender contempt for the justice system.<br /><br />The accused - almost inevitably a recidivist wrong' un - celebrates getting off with what everyone knows they did; the victim sees their transgressor walking free, with the State shrugging its shoulders and saying "Whit dae ye expect us tae dae aboot it?"<br /><br />A trial that ends in not proven might as well have not taken place, as it is passed back to the court of public opinion for resolution.
